Hazardous Waste Management Authorization

Hazardous waste generators, transporters, and treatment, storage, and disposal facilities (TSDFs) are required to obtain a Hazardous Waste Management Authorization (HWM Authorization) from the Ministry of Environment & Climate Change (MOECC).

The MOECC does not issue HWMs for industrial, commercial or institutional facilities. The person who owns or operates an industrial, commercial or institutional facility must apply for authorization from the Ontario Ministry of Labour (OMOL).

HWMs are issued by the MOECC to individuals, including private citizens and small businesses, who wish to manage their own hazardous waste. After that, The MOECC issues HWMs to individuals who generate less than 50 kg per month of hazardous waste or less than 200 kg per year. Citizens can also apply for HWMs if they want to ship their own household hazardous waste for recycling.

  • You must be a “person” as defined in the Act. A person may be an individual, partnership, company, or corporation.
  • After that, You must operate a facility that is not exempted from the requirement to obtain authorization.
  • Must have an environmental permit to operate your facility.
  • You must have an environmental compliance approval issued by MOECC for your facility.
  • Memorandum of Association (MOA)
  • Articles of Association (AOA)
  • List of Directors/Managing Directors/Employees with their contact details
  • After that, a Certificate of Incorporation issued by Registrar of Companies or equivalent authority under the Companies Act 1956 or any other applicable law in force in India
  • After that, Copy of Business Registration Certificate issued by Registrar of Companies or equivalent authority under the Companies Act 1956 or any other applicable law in force in India.

Process of getting authorization under the Hazardous Waste Management Rules

  • The process of getting authorization under the Hazardous Waste Management Rules is not an easy task. The application for authorization should submit to the pollution control board at least three months before the commencement of operation.
  • After that, The application should contain all the details about the hazardous waste management system that you are planning to implement. You need to mention your location, type of business, and type of hazardous waste generated.
  • Also need to mention how you would manage waste in case there is no market for it. You need to explain how you will dispose of off the waste if there are no buyers available for it.
  • The application should also include a proposal on how you would manage different types of waste generated from your business. It should also include details about how you will segregate the waste based on its category and how it would be treated or disposed off accordingly.
  • It is important that you submit all documents relevant to this process along with your application form so that no problems crop up later on in this regard.

There are three types of HWMs:

  • Transporters; And
  • TSDFs.

Hazardous Waste Management Authorization

Meanwhile, A facility that stores, transfers, or treats must obtain a Hazardous Waste Management authorization from the Department. After that, The authorization shall be effective until the expiration date specified on the authorization. The authorization may renew by the Department prior to its expiration date if the facility continues to meet all applicable requirements of this regulation and has not been subject to any order or penalty under this regulation during the preceding three years.
